Introduction
The purpose of this 540 Sports and Entertainment, LLC Privacy Policy is to inform you, as a welcome visitor to an 540 SE Website, what kinds of information we may gather about you and how we may use that information, whether we disclose it to anyone, and the choices you have regarding our use of, and your ability to correct, the information.
Definitions
“540 SE” – 540 Sports and Entertainment, LLC.

540 SE is strongly committed to protecting the privacy of its Consumers that utilize its interactive products and services. Since inception, 540 SE has pledged never to sell or otherwise misuse client information including (but not limited to) names, addresses, telephone numbers, email addresses or other personal data of those it collects (Personal Information). 540 SE only collects this information knowingly to its Consumer, and will never collect personal data by any means unless specifically submitted by Consumer. 540 SE considers all Consumer Personal Information to be private and confidential, and this information will not be distributed in any manner unless permitted by Consumer.
540 SE has a policy against using third party Internet advertising solution providers and free email services that collect and sell private data from our users. To protect your information, all advertising programs for banner ads, databases and software applications that require Consumer Personal Information reside exclusively on the 540 SE internal servers and databases. 540 SE will not release any Personal Information to any party regarding Consumers or prospective clients.
540 SE Website link to other websites, and other websites link to 540 SE Websites. 540 SE is not responsible for the privacy practices of other companies or the content of websites not owned, operated, and/or solely managed and maintained by 540 SE. Other organizations may have their own privacy policies, in which you should review when you access and/or utilize their services.
Disclosure
We do not use or disclose Personal Information about you or your individual visits to 540 SE Websites, or information that you may submit to us through 540 SE Websites, to any outside companies. 540 SE may share such information in response to legal process, such as a court order or subpoena, or in special cases such as a physical threat to you or others. And, as discussed in detail below, we may share collective statistical information with our Affiliates about the use of 540 SE Websites.
Information Specifically Relating to 540 SE Website Visitors
Whenever a file is accessed or is attempted access on 540 SE server, the relevant 540 SE Website server automatically gathers certain usage information about that visit (including, without limitation, the numbers and frequency of its visitors and its specific areas, pages, and miscellaneous files or applications). Be aware that some online forms may reside on non-540 SE Websites (if linked off of a 540 SE Website or of which is noted within that form), in which 540 SE is not responsible for their privacy practices.
Promotions that run on 540 SE Websites may be sponsored by companies other than 540 SE or may be co-sponsored by 540 SE and another company. Some or all Personal Information provided by you during a promotion may be shared with the sponsor. If information will be shared, we will disclose such sharing prior to the transfer. You can decide not to participate in the promotion if you do not want your Personal Information to be shared. In certain circumstances, you may not be able to participate in a particular promotion if you chose not to share certain Personal Information.
Certain 540 SE Websites run competitions or contests through the Website, and you may be required to provide Personal Information if you wish to participate. It is possible that 540 SE may ask you for information about your interests so that both you and we can take advantage of the interactivity of the online medium, but you may always choose whether or not you want to respond to these questions.
Information Specifically Relating to 540 SE Clients
All 540 SE clients are required to supply certain Personal Information to 540 SE for its records and to help deliver certain features of service that contain Personal Information, such as, but not limited to e-mail and login applications; and to authenticate your access to your Personal Information. 540 SE considers all clients Personal Information to be private and confidential, and this information will not be distributed in any manner unless permitted in writing by client.
Protecting Our Youth
Given the nature of and content included in many 540 SE Websites, children may be inclined to visit and interact with our Websites. To help protect the privacy of children, any individual under the age of EIGHTEEN (18) should not send any Personal Information about themselves without parental consent to 540 SE or through any 540 SE Website. In general, 540 SE does not knowingly collect and store Personal Information of children under the age of EIGHTEEN without their parental consent.
There are only a few circumstances for which 540 SE would knowingly collect a child’s Personal Information that is under the age of EIGHTEEN, WITH PARENTAL CONSENT:
1.) Necessary behind-the-scenes account and/or necessary service-related information for the following features and services: Fan clubs, contests, public message boards, public chat rooms, newsletters, product purchases (online or offline), and special access or subscription areas (e.g. Kids Zone). UNDER NO CIRCUMSTANCE WILL 540 SE ALLOW ANY CHILD UNDER THE AGE OF EIGHTEEN TO KNOWINGLY HAVE ACCESS TO ANY PRIVATE CHAT ROOM OR SESSION.
2.) Posting on 540 SE Websites for the following services and features: Derivations of “fan lists”, contest submissions, contest winners, article submissions, image or graphic submissions, story or poetry submissions, fan club member lists, public message boards, public chat rooms and newsletters. For these features and services, 540 SE or its Affiliate may post (but no more than) a child’s name, age, city and state of residence. UNDER NO CIRCUMSTANCE WILL 540 SE KNOWINGLY POST OR ALLOW POSTING OF ANY CONTACT INFORMATION FOR A CHILD UNDER THE AGE OF EIGHTEEN, OR KNOWINGLY ALLOW SUCH CHILD TO HAVE ACCESS TO ANY PRIVATE CHAT ROOM OR SESSION.
540 SE will use any knowingly collected Personal Information of a child under the age of EIGHTEEN for only the means described within the “Protecting Our Youth” section, and will use this information only for necessary and official 540 SE and 540 SE Affiliate use for the service the information was specifically collected for. No Personal Information of any child under the age of EIGHTEEN will be distributed to any other third party under any circumstance.
540 SE reserves the right, by law, to send a one-time response to an email (with appropriate and ethical content) sent by a child under the age of EIGHTEEN if that child sent an email to 540 SE with or without parental consent. Given that, immediately following the one-time response if there was no parental consent, 540 SE will delete the child’s email address and any additional Personal Information acquired through the email from its contact database. We strive to help youth enjoy positive online experiences, and enjoy answering questions or concerns they have regarding any Website-related issue if and when appropriate.
In the event we learn that we have collected any Personal Information from a child under the age of EIGHTEEN without parental consent (beside the one exception mentioned above), we will delete that information from our database immediately. In addition, if at any time you as a parent would like to request the removal of any information of your child from an 540 SE Website and/or any relevant database, please contact us immediately and we will gladly honor your request.
540 SE takes special care to protect the safety and privacy of young individuals using our services, and encourages you to participate in your child's online experience. Data Security
540 SE has in place physical, electronic and managerial procedures to protect the information we collect online. However, as effective as these measures are, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that the information you supply will not be intercepted while being transmitted to us over the Internet. Given that, to date and to the best of our knowledge, no 540 SE databases has ever been “hacked” into or compromised in any way.
Privacy Policy Updates
Technology on the Internet, as well as with electronic media is developing rapidly. Should our policy change, we will post these changes as soon as they go into effect. We reserve the right to update the Privacy Policy at any time and without notice.
